My Total Health, Inc. (“we”, “us” or “our”) respects your privacy and we committed to protecting it through our compliance with this Privacy Policy. We have created this Privacy Policy to inform you of our policies regarding the collection, use and disclosure of personal information and the choices you have associated with that information. Capitalized terms used but not defined in this Privacy Policy have the meaning given to them in our other policies (e.g., our Terms of Use).
This Privacy Policy applies to all personal information collected through any written, electronic, or oral communications, and collected online or offline as you:
- Access the website located at https://mygi.health, and all corresponding webpages and websites that link to this Privacy Policy (the “Site”);
- Use any mobile, web, console, desktop and other applications you download from this Site, which provide dedicated non-browser-based interaction between you and this Site;
- Interact with our advertising and applications on third party websites and services, if those applications or advertising include links to this Privacy Policy;
- Utilize our Services, including the partner laboratories.
This Privacy Policy provides details of MyGiHealth’s privacy practices with respect to the App and the Service. Before using our Site and Services, please carefully read our Terms of Use, which you can view here: https://mygi.health/terms and this Privacy Policy. By using this Site, you consent to the collection and use of the Personal Information in accordance with this Privacy Policy and our Terms of Use. If you do not feel comfortable with any part of this Privacy Policy or our Terms of Use, you should not use or access our Site or Services.
We may modify this Privacy Policy at any time, without prior notice, and changes may apply to any Personal Information we hold about you, as well as any new Personal Information collected after the Privacy Policy is modified. If we make changes, a revised Privacy Policy will be posted to our Site; the date of the last revision is included at the top of the page. We will provide individuals who create an Account (“Members”) with advanced notice by email if we make any material changes to how we collect, use or disclose Members’ Personal Information or that impact Members’ rights under this Privacy Policy. Members are responsible for ensuring we have an up-to-date active and deliverable email address to reach them. Your continued use or revisitation of the Site or the Services following the posting or notice of a revised Privacy Policy means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.
My Total Health, Inc., through its mobile app branded as MyGiHealth (“MyGiHealth,” “we,” “us”) provides a suite of evidence-based tools that allows you to assess and monitor your GI symptoms, access educational content tailored for your symptoms, better connect with your doctor, receive customized GI wellness tips, and connect with a supportive community. MyGiHealth makes this information and connectivity available to individual consumers (“Consumer,” “you”) through the use of the MyGiHealth mobile app. The information made available to you and the connectivity with your healthcare provider(s) and the community via the mobile app is referred to as the Service. You may invite one or more people (such as your medical professional) who are considered “Providers,” each of whom will have some level of access to your personal information.
Please read this Privacy Policy carefully. By using the Service you expressly consent to the collection, use and disclosure of your personal information in accordance with this Privacy Policy. Your use of the Service, and any dispute over privacy, is subject to this Privacy Policy and the Terms of Use, including its applicable limitations on damages and the resolution of disputes. The MyGiHealth Terms of Use is incorporated by reference into this Privacy Policy.
Information We Collect About You and How We Collect It
We collect personal information when you use our Site and our Services. Personal information is any information that relates to you, identifies you personally or could be used to identify you including, but not limited to: your name, mailing address, email address, telephone number, or any other information defined as “Protected Health Information” under HIPAA laws and regulations.
The types of personal information that we may collect include, but are not limited to: the information you provide to us, information collected automatically about your use of our Site, information from third parties, including our business partners.
Information We Collect Directly From You
Your use of the Service and requires registration. The initial registration is limited to basic information such as your name, email address, a username and password you select, your gender and your date of birth. We also may collect information from you that you have voluntarily submitted, such as information that you or your Provider uploads as well as information generated by the Service. The following are other examples of personal information that MyGiHealth:
- information relating to your condition, such as GI symptom descriptions, frequency, type, and severity;
- information relating to your use of the Service (e.g., reminders, alerts, and permission settings) or Provider’s receipt of reminders and alerts and access to the Portal;
- information that you provide when responding to questionnaires and surveys;
- information about you when you contact the MyGiHealth Support Line or us (for example with a question about the Service) or if we contact you in connection with the Service
You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Site, or transmitted to other users of the Site or third parties (collectively, “User Content”). Your User Content is posted on and transmitted to others at your own risk. We cannot control the actions of other users of the Services with whom you may choose to share your User Content. Therefore, we cannot and do not guarantee that your User Content will not be viewed by unauthorized persons.
If you choose to utilize our Lab Services, you will collect the appropriate biological sample(s) using a sample collection kit. The sample and your information will be provided to a Lab for the purpose of providing the Services. The Lab will store your test results and related data as required by applicable laws, regulations, and CLIA accreditation standards. Samples and test related data may be used or stored for regulatory compliance or healthcare operations, and de-identified for internal quality control, validation studies, and internal research and development purposes.
Information We Collect Automatically
We may collect the following information about your use of the mobile app: mobile device ID; location and language information; device name and model; operating system type, name, and version; your activities within the mobile app; and the length of time that you are logged in through the mobile app. We may combine this information with other information that we have collected about you, including, where applicable, your user name, name, and other personal information Please see the section “Cookies and Other Tracking Mechanisms” below for more information.
MyGiHealth will use this information to:
- provide you with the Service (Consumer and Provider, respectively);
- enable the Service to contact you and Provider(s) with reminders and alerts in accordance with App functionality and Consumer’s settings;
- contact you with administrative/service related notices;
- investigate, and assist you with, any questions or complaints that you may have about the Service;
- carry out market research;
- to improve clinical care and contribute to medical science and literature;
- analyze use of the Service;
- analyze the performance of the Service;
- enhance the Service and to develop new products and services;
- contact you for feedback, opinions and suggestions related to the Service via email, surveys, telephone calls and other similar means. Your participation in such feedback activities is voluntary.
Disclosing Your Information
MyGiHealth will not share information about you with third parties except as described in this Privacy Policy. MyGiHealth may disclose your information:
- to our service providers who are involved in providing the Service; these third parties are required not to use personal information other than to provide the services requested by MyGiHealth;
- where there is a change in the ownership of MyGiHealth (e.g., another company acquires MyGiHealth’s business or assets, whether by merger, sale of assets, sale of stock, through bankruptcy, or otherwise), to the new owners; the new owners will assume the rights and obligations regarding your information as described in this Privacy Policy;
- we may share aggregate or de-identified information with third parties for marketing, advertising, research or similar purposes.
- to researchers and through your participation in surveys, but we will not share personally identifiable information for survey and/or research purposes without your prior consent.
- in connection with any legal investigation or where MyGiHealth (or our service providers) are required to do so by law, regulation or legal proceedings or to respond to subpoenas or warrants.
- to protect or defend the rights or property of MyGiHealth (our Service Providers) or other users.
Enabling Providers to see Consumer Information
MyGiHealth protects the security and privacy of personal information (as described below). However, where you have been given a password, or where you have chosen a password, which enables your access to the App, each user is responsible for keeping their individual password secure and confidential. You should take all necessary steps to ensure the confidentiality of your passwords to avoid third parties gaining unauthorized access to your information. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, smartphone or tablet, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. It is also important that you and your Providers understand that reminders, alerts, and other information communicated from the Service via printed report, email, text, or other means may be viewed by anyone with access to the your or Provider’s mobile device. MyGiHealth accepts no responsibility for any loss, damage or harm arising as a result of your or Providers sharing or disclosing passwords to others. Please contact us immediately if you suspect that there has been any unauthorized access to your account within the App.
Third Party Websites
When you click on a link to any website or location, you will leave the App and go to a site and another entity may collect information from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these websites or content, or to any collection of data after you click on links to such outside websites.
Choices regarding Your Information
You have the right to request a copy of personal information we have about you. If you would like a copy of some or all of that information, please contact MyGiHealth at the address below. There may be a nominal charge for this service but each you should be able to access most of the information via the App itself.
How Users May Request Deletion of Data
You may ask MyGiHealth to correct or remove information by contacting us at support@mytotalhealthinc.com. When you login to the App, you can change certain of your details directly.
As described above, the App may send reminders and alerts via email, push notification, and/or SMS in accordance with your settings and the App version. You may change your reminders and alerts settings to stop these reminders and alerts.
We will periodically send you free newsletters and promotional messages. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the message you receive or by contacting us directly (please see contact information below). Despite your indicated preferences, we may send you service related communication, including notices of any updates to our Terms of Use or Privacy Policy. Please note that it may take up to 10 business days for us to process opt-out requests.
Children Under 13
The Service is not designed for children under 13. If we discover that a child under 13 has provided us with personal information, we will delete such information from our systems.
Where MyGiHealth stores and processes Your Information
Because MyGiHealth has users in different countries, it is important for you to understand that your personal information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of your information may be less stringent than the laws in your country.
Retention of Your Information
MyGiHealth will keep your information for as long as it is necessary to fulfill the purposes for which it was collected, or to the extent permitted or required by law. If your access to the Service and App is terminated, personally identifiable information about your use of the Service and App will not be available to you.
Security
MyGiHealth is committed to protecting the security of personal information we hold. We use a variety of security technologies and procedures to help protect information from unauthorized access, use, or disclosure. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while MyGiHealth uses reasonable efforts to protect personal information concerning you, MyGiHealth cannot guarantee its absolute security.
Changes To This Privacy Policy
This Privacy Policy is subject to occasional revision, and if we make any material changes in the way we use personal information, we will notify you by sending you an e-mail to the last e-mail address you provided to us or through push notification in the mobile app. Any changes to this Privacy Policy will be effective upon the earlier of thirty (30) calendar days following our dispatch of the communication. These changes will be effective immediately for new users. In any event, changes to this Privacy Policy may affect our use of personal information that you provided us prior to our notification to you of the changes. If you do not wish to permit changes in our use of this information, you must notify us prior to the effective date of the changes that you wish to cease using the Service and the App. Continued use of the Service and the App, following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
Special Information for California Consumers
California residents may request a list of certain third parties to which we have disclosed personally identifiable information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. You may request this information in writing. Please allow up to thirty (30) days for a response.
